Conditions

On this page you will find the general conditions, operating rules, and technical requirements governing the supply, delivery, and purchase of materials and metal scrap with our company.

General Conditions of Supply and Purchase

1. Service Provider and Scope of Application

These General Conditions govern all commercial relationships involving the supply, purchase, collection, and delivery of materials and metal scrap managed by Truccolo Angelo S.R.L., with registered office at Via Giacomo Puccini 88, 33074 Fontanafredda (PN), Italy, Tax Code and VAT Number 01794110930.

Unless otherwise agreed in writing, the submission of the order confirmation or the commencement of the supply execution (including the delivery or collection of the material) shall constitute full and unconditional acceptance of these conditions.

2. Tacit Acceptance of the Supply

In the absence of the return of the contractual document duly signed for acceptance, the actual delivery, loading, or collection of the material at the facility shall be deemed, for all legal purposes, as formal acceptance of all clauses set out in the contract and in these General Conditions.

3. Verification of Weight and Classification of the Material

For the purposes of document verification, registration, and invoicing, the net weight and qualitative classification of the material determined at the destination facility or at the operating site of Truccolo Angelo S.R.L. shall be considered exclusively valid.

It is understood that, subject to prior agreement between the parties, weighing operations may also be carried out at third-party facilities or other agreed locations. In such cases, for the purposes of document verification, registration, and invoicing, the net weight and qualitative classification resulting from the weighing and assessments carried out at the previously agreed location shall be considered valid.

4. Waste Requirements, Suitability, and Strict Prohibitions

The supplier/delivering party guarantees the full compliance of the material with the EER code declared in the accompanying documents. The delivered material must be strictly free from:

  • hazardous, toxic or harmful substances, oils, PAHs, PCBs, PCTs, asbestos, batteries, accumulators, radioactive, flammable or explosive substances;
  • closed bodies or pressurized containers of any size (e.g. gas cylinders, fire extinguishers, drums, tanks), which must be previously decontaminated, opened, punctured, or cut;
  • inert materials and foreign waste (soil, concrete, wood, non-agreed plastics, and municipal waste).

5. Management of Non-Conformities and Cost Recovery

If the delivered material is found to differ from what was declared, does not comply with the agreed specifications, or contains prohibited items, Truccolo Angelo S.R.L. reserves the right to reject the load or to reclassify the material to a lower grade. In such cases, only the actual costs incurred shall be charged back to the supplier/delivering party, including, for example:

  • transport costs, extraordinary handling costs, and vehicle downtime charges;
  • any costs for laboratory analyses or technical inspections made necessary by the non-conformity;
  • costs for sorting, separation, cleaning, and disposal of any foreign or contaminating materials found in the load.

6. Liability for Damages and Indemnification

Any non-conformities identified in the supply, as well as any resulting civil or criminal liability for damages caused to persons (including injuries to employees or third parties) or property (including damage to machines and equipment), shall be entirely and exclusively borne by the supplier/delivering party.

7. Obligation to Verify the Material

Truccolo Angelo S.R.L. reserves the right to carry out visual, radiometric, documentary, and any other inspections deemed necessary before, during, and after the unloading of the material. Acceptance of the unloading does not constitute final recognition of the material’s compliance, which may also be disputed at a later date if non-conformities that were not immediately detectable are discovered.

8. Competent Court and Privacy

For any dispute relating to the interpretation, performance, or termination of supply contracts, the exclusive jurisdiction of the Court of Pordenone shall apply.

Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable legislation. The full privacy policy regarding data processing is available in the following section: Privacy.

9. Updates

Any amendments shall apply exclusively to relationships established after their publication, unless otherwise agreed in writing between the parties.
